PROJECT OVERVIEW

JLES South West were appointed as the Specialist Contractor on this scheme to implement the Short Form Section 38 Agreement and finalise the outstanding Section 38 works to achieve adoption. The works included:

• Extensive legal support prior to commencing on-site works to overcome numerous land ownership discrepancies, prior to execution of the retrospective Short Form Section 38 Agreement

• Liaisons with the Local Authority to agree on a viable repair for a 15 year old footpath. Upon agreement, JLES implemented the reconstruction of the highway & installation of Geogrid in between bituminous layers, to add further structural integrity to footpaths where clay heave had caused longitudinal fractures.

• Substantial reduction on landscaping works achieved for the client.

• out on 69 columns due to age and land ownership discrepancies that required extensive coordination to ensure minimum disruption was inflicted on the residents.

CHALLAGES

JLES South West and JLES Legal spent umpteen months working through various land discrepancy issues where adoptable highway and street lights had mistakenly been conveyed to some of the residents. JLES undertook numerous meetings with the Local Authority and implemented resolutions including column relocations and adoptable highway boundary amendments, which subsequently enabled the short form section 38 to be implemented once resolved. Upon implantation of the short for section 38, the on site works were completed without any further hindrances, and the highways were adopted within 2 months of the completed works.
