Q. What is an un-adopted site?
A. A development built by/ on behalf of you where the site infrastructure (Roads & Sewers) were supposed to be transferred to the Local Authority/Water Company but have not yet been.

Q. Why do we need to achieve adoption?
A. There are numerous benefits and motivators for housing associations to pursue adoption not to mention the fact they have other historically signed legal agreements (Section 38 1990 Highways Act / Section 104 Water Industry Act 1999) that they are currently in breach of.

Q. What are the benefits and motivators for us pursuing adoption?
A.
i) Allows you to cancel related bonds of which there is usually a quite expensive associated facility fee.
ii) Often on older sites an Advance Payment Code has been paid hence upon adoption we are able to retrieve monies previously disregarded by your company.
iii) Until adopted your company is responsible for the required maintenance
iv) You are currently liable for any injuries sustained or damages sought due to a trip or fall on the highway or problems associated with the drainage.
v) You are in breach of the legal agreement which until resolved can cause problems with future planning proposals with the relevant Local Authority.
vi) By pursuing and achieving adoption you are demonstrating a pro-active approach and eagerness to achieve adoption which is essentially a social responsibility.
vii) Upon achieving adoption bonds can be cancelled allowing for instant improvement of a company’s financial standing by amending and reducing the liabilities section of your balance sheet.
viii) We produce update reports which are issued to key parties. Reporting positive progression improves your companies profile and image.

Q. How do I ascertain what we are currently liable for?
A. We have key relations with the majority UK bondsman provides as well as adopting authorities and can compile a list of unadopted sites free of charge and validated.

Q. Where/how do we know where to start with progressing the scheme?
A. We have comprehensive systems and tools to ensure resources and monies are best spent for maximum result.

Q. How do we progress the schemes without increasing overheads or internal resources?

Q. How do I control the cost?
A. Our unique adoption reports detail a lump sum guaranteed cost foe JLES to achieve adoption on behalf of the client.

Q. What if the developer/builder is supposed to be progressing the developer on our behalf?
A. The developer is unlikely to detail or confirm any issues preventing adoption that they are accountable. Often as they have not provided the bond there is no or little motivation for them to actively pursue action.

Q. What if we have retentions or an agreement for the original contractor/developer to progress the site.
A. We provide you with options of how to progress one of which always includes our cost to manage and pursue your nominated contractor to complete the required works.

Q.Why do we seem to have such a backlog of unadopted legacy roads and sewer?
A. You are not alone! Housing Associations have a wide range of diverse responsibilities to fulfil and as adoption is a very specialist field it is often unrealistic or unpractical to feasibly tackle/address these issues.
